Articles 10 and 13 of  Decree Law 196/2003

In relation to the processing of personal data, the subject concerned has the right:

a) to know, through free access to the register referred to in Article 31, paragraph 1, letter a), the existence of personal data concerning the subject;

b) to be informed as to what referred to in  Article 7, paragraph 4, letters a), b) and h);

c) to obtain from the proprietor or manager, without delay:

  1. confirmation as to the existence or lack thereof, of  personal data concerning him, even if not yet recorded, and communication in an intelligible form of the data and their origin, as well as of  the logic and purposes on which it is processed; the request may be renewed, unless there are justified reasons, after not less than ninety days;
  2. cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
  3. updating, rectification or, where interested therein, integration of data;
  4. certification that the operations referred to in 2) and 3) have been notified, also as regards their contents, to those to whom the data were communicated or disseminated, except where the fulfillment of this requirement proves impossible or involves a manifestly disproportionate effort compared to the protected right;

d) to oppose, in whole or in part, for legitimate reasons, the processing of personal data, even if pertinent to the purpose of collection;

 e) to oppose, in whole or in part, the processing of personal data concerning him, for purposes of commercial information or delivery of advertising materials or direct selling, or for carrying out market research or interactive commercial communication, and to be informed by the owner, not later than the time in which the data are communicated or disclosed, of the possibility of exercising this right free of charge .
